1. General Provisions1.1. This document is the official public offer (the "Offer") of FOP Mykytyuk Oleksandr, hereinafter referred to as the "Service Provider," to enter into an agreement under the terms set forth below with any individual or legal entity, hereinafter referred to as the "Customer."1.2. Acceptance of this Offer is considered the fact of placing a service order or making a payment based on an issued invoice.
2. Subject of the Agreement2.1. The Service Provider provides the Customer with services for diagnostics, coding, programming, restoration, and retrofitting of BMW vehicles, including remote services.2.2. The specific list of services, scope, cost, and completion time are determined during the order agreement process with the Customer.
3. Order Placement3.1. Orders can be placed through the website, messengers, email, or phone.3.2. The Customer is obliged to provide accurate and up-to-date information necessary for the service.
4. Service Cost and Payment Procedure4.1. The cost of services is determined individually or published on the website.4.2. Payment is made to the Service Provider's bank account:IBAN: UA7730529900000260000407136954.3. The service is considered ordered after payment confirmation.
5. Rights and Obligations of the Parties5.1. The Service Provider undertakes to:● Provide a high-quality service● Inform about any technical limitations or risks● Adhere to the deadlines agreed with the Customer
5.2. The Customer undertakes to:● Provide all necessary information● Ensure access to the vehicle or equipment (in case of remote work)● Pay for the service on time
6. Liability of the Parties6.1. The Service Provider is not liable for consequences related to improper vehicle operation, third-party interference, or hidden defects.6.2. The Service Provider is not responsible for internet connection disruptions if the service is provided remotely.
7. Refunds7.1. Properly provided services are non-refundable.7.2. If a service is not provided due to the fault of the Service Provider, the full amount will be refunded.
8. Force MajeureThe parties are not liable for non-fulfillment of obligations in the event of force majeure (war, natural disaster, power outage, etc.).
9. Offer Validity9.1. This Offer is effective from the moment of publication on the website and is valid indefinitely.9.2. The Service Provider reserves the right to amend the Offer without separate notification. The current version is always available on the website.
